Revisjon av åndsverkloven - paneldebatt I denne paneldiskusjonen vil vi dykke ned i de foreslåtte endringene i åndsverksloven, med særlig vekt på gjennomføringen av EUs digitalmarkedsdirektiv. Lawful Access, TDM and Generative AI under EU Copyright Law Article 3 and 4 of the DSM Directive, which may arguably serve as legal basis for training AI on copyright protected works, both require that the user have “lawful access” to the works in question. In other parts of EU copyright law, we find similar, but not identical requirements as “lawful use” and “lawful source”. Remuneration of rightsholders for the training of AI models, particularly based on DSM art. 4 There is a growing recognition that human creators should receive some remuneration when the materials they have created are used to train AI. Professor Inger Ørstavik, Professor Ole-Andreas Rognstad and Research Fellow Guro Bøe Linnet discuss possible economic justification models for such remuneration, how they fit with the European copyright framework (notably DSM art. 4) and various remuneration schemes compatible with the current legal framework. |
